Terms of Service

Draft — under legal review. These Terms of Service have not been finalized. Do not use VellumGuard for regulated production data, PHI, or customer-sensitive production workloads unless separately agreed in writing with VellumGuard. VellumGuard is not currently SOC 2 certified, is not currently HIPAA compliant, and no Business Associate Agreement (BAA) is currently available.

VellumGuard is currently in private beta / design-partner access. Finalized Terms of Service will be published at this URL before any public or commercial launch. The notes below describe the current operating terms during the beta period.

Beta access

Access to the VellumGuard API and SDK during the beta period is granted at VellumGuard's discretion to design partners. Beta access may be revoked at any time. VellumGuard is not liable for data loss or service interruptions during the beta period.

No formal SLA

There is no service-level agreement (SLA) during the beta period. VellumGuard operates on a best-effort basis. Response targets are published at the beta readiness section of the homepage but are not contractual commitments.

Acceptable use

• Use VellumGuard only for lawful purposes.
• Do not attempt to extract, export, or reverse-engineer private key material from the VellumGuard KMS.
• Do not use VellumGuard to encrypt, store, or transmit PHI, PCI card data, or other regulated personal data without a separate written data-handling agreement.
• Do not share API keys with unauthorized parties. Revoke and replace any key that may have been exposed.
• Do not attempt to exceed rate limits or circumvent access controls.

Intellectual property

The VellumGuard SDK is open-source. The VellumGuard hosted service, brand, and website content are proprietary to VellumGuard. The ciphertext format specification is public.

Confidentiality

The VellumGuard API, SDK, and partner documentation are confidential to the design-partner cohort during the beta period. Do not share them publicly without VellumGuard's written consent.

Pricing and billing

Beta access is free unless otherwise agreed in writing. No charges will be made without a written agreement that specifies pricing terms before the GA launch.

Warranties and liability

The VellumGuard service is provided "as is" during the beta period without warranty of any kind. VellumGuard is not liable for damages arising from use of the service during beta. Finalized terms will define warranty and liability scope before GA.

Changes

These terms may be updated at any time during the beta period. Material changes will be communicated to active design partners via email.
